Resumo:São estudados fatores ocorridos no Maluí que impediram o desenvolvimento de uma jurisprudência em prol dos pobres, o que era esperado, devido a adoção em 1994, de uma constituição democrática, na qual o Judiciário emergia como uma instituição de força, contrapondo-se a um sistema político fraco.
